Data controller: A.M.E.S. S.r.l., Via Persicetana 16/2, 40012 Calderara di Reno (BO) — VAT No. 00538431206, Tax Code 01190350379.
A.M.E.S. srl operates this website, including its information, content, features, tools and products, in order to offer you a searchable catalogue and a quote request service (the "Services"). The site does not allow direct online purchase: each supply is agreed through a separate commercial agreement, initiated with a quote request and concluded by email or another direct channel. A.M.E.S. srl is supported by Shopify, which enables us to provide you with the Services. This Privacy policy describes how we collect, use and disclose your personal data when you visit or use the Services, request a quote, register as a B2B customer or communicate with us. In the event of a conflict between our Terms of service and this Privacy policy, the Privacy policy prevails in relation to the collection, processing and disclosure of your personal data.
Please read this Privacy policy carefully. By using and accessing the Services, you confirm that you have read this Privacy policy and understood what is described in relation to the collection, use and disclosure of your information.
The personal data we collect or process
When we use the term "personal data", we mean information that identifies, or can reasonably be linked to, you or another person. We may collect or process the following categories of personal data, depending on your interaction with the Services, where you live and to the extent permitted or required by applicable law:
- Contact details including name, company name, address, delivery address, telephone number and email address.
- B2B account data including username, password, company details (VAT number, sector, contact person), preferences and settings.
- Enquiry data including the items you view, add to a quote request or to a comparison list, and the history of your requests and orders confirmed off-platform.
- Communications with us including the information you include in communications with us, for example support or quote requests.
- Device information including information about your device, browser or connecting network, your IP address and other unique identifiers.
- Usage information including information about your interaction with the Services, as well as how and when you interact with or browse the Services.
Note: we do not collect payment data (card numbers, financial account details) through the site, as there is no online purchase/checkout system. Any payment data relating to confirmed supplies is handled through separate channels (e.g. bank transfer, invoice) and not through the site.
Sources of personal data
We may collect personal data from the following sources:
- Directly from you, when you create an account, visit or use the Services, request a quote, communicate with us or provide us with your personal data;
- Automatically through the Services, through your device when you visit the site, and through the use of cookies and similar technologies;
- From our service providers, when we engage them to implement a particular technology and when they collect or process your personal data on our behalf;
- From our partners or third parties.
How we use your personal data
Depending on how you interact with us, we may collect your personal data for the following purposes:
- Providing, personalising and improving the Services. We use your personal data to provide you with the Services; to manage your quote request and the resulting business relationship; to remember your preferences and the items you are interested in; to send you notifications relating to your account or your request; to create, maintain and manage your B2B account; to arrange delivery of agreed goods; and to create a personalised browsing experience, for example with product suggestions linked to your previous requests.
- Marketing and advertising. Only with your explicit consent, we use your personal data to send you marketing, advertising and promotional communications by email, text message or post, and to show you online adverts within our Services or on other websites.
- Security and fraud prevention. We use your personal data to authenticate your account; to detect, investigate or take action against any fraudulent, illegal, unsafe or harmful activity; and to protect the security of our services. We recommend that you do not share your username, password or other login details with anyone.
- Communicating with you. We use your personal data to provide customer support, respond to your enquiries and maintain our business relationship with you.
- Legal reasons. We use your personal data in accordance with applicable laws or in response to valid legal proceedings, including requests from public authorities; to investigate or take part in potential or ongoing claims; and to enforce or investigate potential breaches of our terms or policies.
How we disclose personal data
In certain circumstances we may disclose your personal data to third parties for legitimate purposes, subject to this Privacy policy:
- With Shopify, suppliers and other third parties that perform services on our behalf (e.g. IT management, site hosting, data analytics, customer support, logistics for agreed deliveries).
- With commercial and marketing partners, only with your consent, to provide you with marketing services and adverts.
- When you ask or authorise us to disclose certain information to third parties, for example to arrange a delivery.
- With our affiliates or within our corporate group.
- In connection with a business transaction such as a merger; in compliance with any legal obligations; to enforce our terms or policies; and to protect the Services, our rights and those of our users.
Relationship with Shopify
The Services are supported by Shopify, which collects and processes personal data relating to your access to and use of the Services in order to provide and improve the Services for you. Data you submit to the Services will be transmitted to and shared with Shopify and third parties that may be located in countries other than your own. For more information on how Shopify uses your personal data and the rights you may have, you can consult Shopify's Consumer Privacy Policy.
Third-party websites and links
The Services may contain links to websites or online platforms operated by third parties. We do not guarantee, and are not responsible for, the privacy and security of such sites, nor the accuracy of the information they contain.
Children's data
The Services are not intended for use by minors, and we do not knowingly collect personal data from persons below the age of majority in your jurisdiction. If you are the parent or guardian of a minor who has provided us with their personal data, please contact us to request its deletion.
Data security and retention
No security measure is perfect or impenetrable, and we cannot guarantee "absolute security". We recommend using only secure channels to send us confidential information. How long we retain personal data depends on various factors, such as the need for that data to manage your account, provide you with the Services, comply with legal obligations (e.g. retention of tax/accounting records) or resolve disputes.
Your rights and choices
Depending on where you reside, you may have one or more of the following rights:
- Right of access/to know: to request access to the personal data we hold about you.
- Right to erasure: to request the deletion of the personal data we hold about you.
- Right to rectification: to request the correction of the personal data we hold about you.
- Right to data portability: to receive a copy of your personal data and ask us to transfer it to a third party, in certain circumstances.
- Managing communication preferences: you may explicitly opt out of promotional emails at any time via the unsubscribe option.
If you reside in the United Kingdom or the European Economic Area, you may also exercise:
- Objection to processing and restriction of processing: asking us to stop or restrict the processing of personal data for certain purposes.
- Withdrawal of consent: where your consent is required to process your personal data, you have the right to withdraw it at any time, without affecting the lawfulness of processing carried out before the withdrawal.
You can exercise these rights by contacting us using the details provided below. Before processing your request, we may need to verify your identity, to the extent permitted by applicable law. We will respond to your request within the reasonable timeframes set out by applicable law.
Complaints
If you have any complaints about how we process your personal data, please contact us using the details provided below. You also have the right to lodge a complaint with your local data protection authority — for Italy, the Garante per la protezione dei dati personali.
International transfers
We may transfer, store and process your personal data outside the country in which you reside. Where data is transferred outside the European Economic Area or the United Kingdom, we will rely on recognised transfer mechanisms, such as the European Commission's Standard Contractual Clauses, unless the transfer is to a country deemed to provide an adequate level of protection.
Changes to this Privacy policy
We will update this Privacy policy from time to time, including to reflect changes to our practices. We will publish the updated policy on the website and amend the "Last updated" date.
